In this seminar, part of the Judge’s Series of talks again arranged by the Succession and Protective Law Committee, the Hon. Justice Fabian Gleeson will share his perspectives about the potential impact of Kramer v Stone. What encouragement might a claimant find from the reasons of the majority in Kramer to pursue a proprietary estoppel by encouragement claim? How does an encouragement claim differ from an estoppel by acquiescence? What challenges remain in estate litigation and more generally for barristers wishing to prosecute, or resist, estoppel by encouragement claims?
