Navigating the “murky waters” of s 151Z of the Workers Compensation Act 1987 (NSW)

The NSW Bar Association’s Common Law Committee is pleased to invite you to attend a seminar on ‘Navigating the “murky waters” of s 151Z of the Workers Compensation Act 1987 (NSW)’. The seminar will be held online via Zoom at 5:00 pm on Wednesday 9 April 2025. 

Section 151Z of the Workers Compensation Act 1987 (NSW) regulates the recovery of workers compensation and common law damages where a worker has a claim or potential claim against a third party tortfeasor in respect of the worker’s injury.  It has been described as a “notoriously difficult” provision to apply.  This seminar will address the apparent objectives of the section, broadly outline its operation, consider the key authorities that have clarified aspects of its operation and address some of the practical considerations that arise when the section is engaged.  There will be particular focus on Synergy Scaffolding Services Pty Ltd v Alelaimat [2023] NSWCA 213 and Synergy Scaffolding Services Pty Ltd v Alelaimat (No 2) [2024] NSWCA 11.
