Message from the Department of Communities and Justice regarding BailSafe Australia

The NSW Department of Communities and Justice (DCJ) has contacted the NSW Bar Association regarding BailSafe Australia, which we are informed is an independent electronic monitoring service provider nominated in electronic monitoring bail conditions under section 30A of the Bail Act 2013 (NSW).
The DCJ has indicated that reports suggest that BailSafe Australia may have ceased operations without notice to the court, nor the accused persons being monitored by its devices.
The DCJ has provided this information to assist those members who may be involved in making submissions in bail proceedings or working on operational bail matters.
The status of BailSafe Australia has not been independently confirmed by the NSW Bar Association. Media reports have indicated that the DCJ has commenced a review of the regulation of private electronic monitoring devices to determine if it can be improved.
