External examiners for trust money accounts

Practitioners are reminded that if you have received fees in advance during the year 1 April 2019 to 31 March 2020, you will need to appoint an External Examiner to carry out an examination of your trust money account, and submit a copy of that examination report to the Bar Association by no later than 7 June following the end of that period. It is essential that the 2020 form is used, as approved by the Legal Services Council and Bar Council.

Barristers who have notified the Association of having opened a trust money account will sent a reminder, with a link to the 2020 form.

The form is available here and from the Members’area of the Bar Association website.

Your attention is drawn to the final page of the form entitled ‘Certification – External Examiner’. The person must have completed a course of education approved by the Legal Services Council. The Law Society of NSW provides training courses and is responsible for approving persons to become external examiners.

Completed forms can be emailed to pcd@nswbar.asn.au or sent by post to the Bar Association, for the attention of the Professional Conduct department’.
