Amendment to the Uniform Civil Procedure Rules - Amendment to rule 35.3B and forms 40 and 163

On 6 August 2025 the Uniform Rules Committee approved Amendment No 106 to the Uniform Civil Procedure Rules and an amendment to UCPR forms 40 and 163.

Amendment No 106

The amendment relates to rule 35.3B – Use of generative artificial intelligence in affidavits.

The amendment changes the restriction on the use of generative artificial intelligence to generate the content of affidavits to ensure consistency with the restriction on the use of generative artificial intelligence to generate the content of witness statements. The amendment commenced on 8 August 2025.

UCPR Forms 40 and 163

The following forms have been amended to clarify that the requirement to disclose the use of generative artificial intelligence in annexures or exhibits to affidavits and witness statements is limited to a deponent’s or maker’s knowledge:
