Message from the Local Court of NSW: Local Court Super Callovers

The Chief Magistrate, His Honour Judge Allen has requested a series of callovers of pending hearings, to be conducted at the following locations:

• Bankstown
• Burwood
• Campbelltown
• Downing Centre
• Gosford
• Liverpool
• Newtown
• Penrith
• Parramatta
• Waverley
• Wyong

The majority of the nominated callover dates have been created by restoring cut courts or utilising a court that is available at a location because of a scheduled chamber day. These dates will be provided by the Registrar at each location.

Priority is given to matters listed for hearing after 1 February 2025 including part-heard matters. Matters should be prioritised as follows:

1. Defendant in custody, matter pending for over two years, DV

2. Defendant in custody, matter pending for over two years, non-DV

3. Defendant in community, matter pending for over two years, DV

4. Defendant in community, matter pending for over two years, non-DV

5. Defendant in custody, matter pending for 1-2 years, DV

6. Defendant in custody, matter pending for 1-2 years, non-DV

7. Defendant in community, matter pending for 1-2 years, DV

8. Defendant in community, matter pending for 1-2 years, non-DV

Notices of Readiness should be completed by both the prosecution and defence and be returned to the Registry 21 days prior to callover. (see attached forms here and here)

The Chief Magistrate expects that the prosecution and defence would have entered into discussions before the callover, and provide a representative to the callover with sufficient authority to ensure that matters can be effectively dealt with, including to finality;

a. These matters are being listed with a view to parties being in a position to provide the court with unambiguous advice as to the state of readiness;

b. If a defendant intends to enter a plea on the day of the callover, the court will proceed to sentence;

c. If a defendant does not wish to enter a plea, the matter will be given a new hearing date from 1 February 2025.

Practitioners with matters listed for hearing after February 2025 at the 11 identified court locations may wish to contact the registry to seek to have their matter considered for inclusion in any super callover.
