High Court decision in Charisteas v Charisteas & Ors

The High Court delivered its judgment this week in Charisteas v Charisteas & Ors [2021] HCA 29 where an appeal was granted to an applicant after the respondent’s barrister and the trial judge failed to disclose communications they had with each other after judgment was reserved but not delivered. The Court found that the communication without the other party’s consent should not have occurred at all, and the failure to disclose this communication was troubling.
