Amendment to the Uniform Civil Procedure Rules - Amendment to Rules 7.1 and 35.3

On 7 November 2022, the Uniform Rules Committee approved Amendment No 99 to the Uniform Civil Procedure Rules.

The following rules have been amended:

• Rule 7.1(5) – by whom proceedings may be commenced and carried on; and
• Rule 35.3(2) – persons who may make affidavit.

The amendment replaces an out-of-date reference to a commercial agent with respect to debt collection as contained in the Commercial Agents and Private Inquiry Agents Act 2004 with a person who carries out commercial agent activity that is debt collection as contained within s 60 of the Fair Trading Act 1987.
