Amendments to the Schedule of Registrar

Chief Justice Spigelman has amended the delegation of functions to registrars under the Civil Procedure Act 2005. Attached is a copy of the amended delegation. The instrument will be published on the Supreme Court web site and in the NSW Gazette.

The amendments:

• give registrars the power to wind up corporations under the just and equitable ground [s.461(1)(k)]

• limit registrars' powers under s.601AH(2) ( to circumstances where the application is not opposed by ASIC

• remove the limitations currently applied in equity proceedings to registrars excercising powers under rules 31.19 and 31.20
