Legal practitioners and Guardianship Tribunal proceedings

Section 58(1) of the Guardianship Act 1987 provides that, if a party to a matter wishes to be represented by a legal practitioner, that party must obtain the leave of the Guardianship Tribunal.� There is no entitlement as of right to legal representation, at proceedings before the tribunal. Practice Note No.1 of 2009 is intended to assist parties and legal practitioners in making applications for leave for representation. It also provides general guidance as to the role of legal practitioners in the tribunal’s protective jurisdiction. This Practice Note will **apply from 18 May 2009 **to all proceedings before the tribunal.
