Queensland Law Reform Commission report: Review of Jury Directions

The Queensland Law Reform Commission has published its report into the directions and instructions given to juries. Two of the key recommendations are: the provision of written material to the jury at the start of a trial covering matters such as the burden and standard of proof, the role of the judge and jury, and elements of each offence being considered; and amending the Criminal Code to allow both the prosecution and the defendant to make submissions to the judge before the summing up about any directions or warnings they may want the judge to include in, or leave out, of the summing up.
