The constitutionalisation of water rights

On Thursday, 3 March 2011 the Honourable Justice Rachel Pepper will present a paper examining the constitutional provisions underpinning access to water as they have emerged in three recent cases, namely, ICM Agriculture Pty Ltd v The Commonwealth [2009] HCA 51; Arnold v Minister Administering the Water Management Act 2000 [2010] HCA 3 and Spencer v Commonwealth of Australia [2010] HCA 28. Justice Pepper will consider the extent to which, if any, the Constitution is able to afford protection to this scarce resource in light of the constitutional and political history of water management to date.� Learn more about membership of the AACL (annual fee of $50) and upcoming events.
