Representative proceedings

The Uniform Civil Procedure Rules (Amendment No.41) 2011 has been published on the Legislation NSW web site and will commence on 4 March 2011. Schedule 1 amends the Uniform Civil Procedure Rules 2005 by inserting Part 58 Representative proceedings. Clause 58.2 provides for an Opt Out Notice, under which any member who wishes to opt out of representative proceedings may do so after filing and serving the prescribed form. Further, on 22 February 2011 the Supreme Court issued Practice Note No. SC Gen 17 on representative proceedings. The practice note will commence on 4 March 2011.
