Important amendment to the Judiciary Act 1903 passed by Parliament

The Law and Justice Legislation Amendment (Identity Crimes and Other Measures) Act 2011 received Royal Assent yesterday, 3 March 2011. Schedule 6(1) of the Act repeals section 55D of the Judiciary Act 1903. The Bar Association had raised the need for this amendment with both the former and current federal governments. The effect of s 55D was that it was� arguable that a person whose name is on the High Court's roll of lawyers was entitled to practise in��the High Court or��a Federal Court without holding a practising certificate. The relevant provision�repealing s 55D�commences the day after Royal Assent, that is, today 4 March 2011.
