Sydney Law School has announced a new postgraduate unit for 2012: Personal Property Securities in the United States. This new August intensive will be taught by Professor Charles W Mooney JR from the University of Pennsylvania Law School.
Personal Property Securities in the U.S. will provide an overview of Article 9 of the Uniform Commercial Code, which deals with security interests in personal property. It will also facilitate a deeper understanding of the recently implemented Australian Personal Property Securities Act 2009 (Cth), which derives in part from Article 9. Topics covered include:
- The creation of an enforceable security interest, protection of a security interest as against third-party claims to collateral ("perfection"), and priority rules as between a security interest and (i) another security interest, (ii) a judicial lien creditor, (iii) a trustee in bankruptcy, and (iv) buyers of the collateral.
- The enforcement of security interests following default.
The unit can attract CPD points
