The end of the Ellis defence

The Archbishop of Sydney, Anthony Fisher, has said the Ellis defence is no longer a legal tactic used within his archdiocese. Speaking on ABC Radio National this morning, Archbishop Fisher said in respect of victims of child sexual abuse: "If they want their day in court then we will help them identify who is the person to sue and make sure that is backed by insurance or assets." The Truth Justice Healing Council has issued a statement, which can be read here. The Bar Association's Common Law Committee is interested in any examples of use of the Ellis defence.
