Tonight: Intentional Torts and exclusions from the Civil Liability Act 2002 (NSW)

The law of negligence was substantially altered with the enactment of the Civil Liability Act 2002 (NSW). The intent of the Civil Liability Act was to clarify aspects of the common law of negligence, but also to limit the number of claims and regulate awards of damages. However, the Civil Liability Act also outlines specific exclusions, where the limiting features of the legislation will not apply. The purpose of this seminar is to consider and discuss the circumstances where the operation of the Civil Liability Act may be excluded in matters involving intentional torts, in particular, by s.3B of the Act.
