International commerce is not a new phenomenon – since antiquity it has served not only as a means by which isolated groups could trade wares but it has facilitated the intermingling and evolution of philosophies, legal and moral norms and trade custom. Upon this built a system of international justice. Whilst there are many variances between the forms of dispute resolution that we might classify as international in nature, by conceptualising these forms of dispute resolution as sitting within a system of international justice, albeit a decentralised and diverse one, we can accommodate these variances and competing interests in our frame of reference and recognise this great feat of international cooperation. This system underpins the prosperity and security of the rules-based international order which promotes good faith and mutual respect and combats insular thinking. We, as legal practitioners in all types of international dispute resolution, should recognise our role in maintaining the integrity of this system which serves all beneficiaries of the international rule of law, as well as the commercial community.
