The Elastication of Vicarious Liability - How far will it stretch?
In 2016, The High Court said that "common law courts have struggled to find a coherent basis for identifying the circumstances in which an employer should be held vicariously liable for the negligent acts of an employee, let alone, criminal acts". Since that time, a steady flow of jurisprudence, linked primarily to historical sexual abuse cases, has emerged. Joined by speaker Shaun McCarthy and chaired by David Hooke SC, this seminar examines those cases and discusses where the law is currently at, and speculates as to where it might end up.
