Strata Management Legislation Amendment Bill 2008: call for submissions

A consultation draft of the Strata Management Legislation Amendment Bill 2008 has been released, proposing changes to the Strata Schemes Management Act 1996 and the Home Building Act 1989.
According to the Office of Fair Trading, the proposed amendments will:
- require owners corporation executive committee candidates and members to disclose personal and business connections with the schemeâs developer, builder or building caretaker/manager;
- clarify that the provisions applying to caretakers apply to anyone carrying out that role, regardless of whether they are known as caretakers, building managers, or by any other title;
- remove the current exemption which enables exclusive use by-laws about parking to be made during the initial period;
- prevent building developers from exercising proxy voting rights obtained through contractual arrangements;
- create a statutory right for an Office of Fair Trading inspector to inspect common property building work on the invitation of individual owners.
The release of the Bill follows a comprehensive consultation process based on the release of the discussion paper âImproving the NSW planning systemâ in November 2007.
