New amendments to the Supreme Court Rules

At its meeting on Monday, 5 May 2008, the Supreme Court Rule Committee approved the�Supreme Court (Corporations) Amendment (No 8) Rules 2008. The object of the amendments, as provided in the explanatory note,�is to make consequential amendments as a result of the commencement of the Corporations Amendment (Insolvency) Act 2007.

The amendments will:

  • make further provision for the remuneration of office-holders involved in the external administration of a company;
  • make provision for applications for the issue of arrest warrants;
  • make other minor changes relating to the obligation to give notice of applications to ASIC, the conduct of meetings ordered by the court and the form of consent of a liquidator or provisional liquidator of a company to act as liquidator or provisional liquidator; and�
  • include a new form of arrest warrant and make minor amendments to the forms.�

These amendments have been developed by the Rules Harmonisation Committee of the Council of Chief Justices.� The Federal Court has already adopted these amendments.
