Speeches to note: Commonwealth AG to examine tax deductibility of litigation

Attorney-General Robert McClelland has identified tax deductibility of legal fees as one of the factors contributing to the rising cost of litigation. The attorney said there may be "some merit in examining the role of public funding where there has been an abuse of process or a case has been unnecessarily or unreasonably protracted".

Speaking in Melbourne�at the Australian Financial Review Legal Conference 2008, the attorney-general outlined a range of measures which could be used to rein in the cost of litigation in the federal court system, including: case management (including Victoria's "Rocket Docket"), ADR and litigation funding.
